Welcome to Companion AI! These Terms of Service ("Terms") govern your use of the Companion AI mobile application (the "App") and services. By creating an account or using the App, you agree to these Terms.
IMPORTANT: Please read these Terms carefully. They contain important information about your legal rights, including mandatory arbitration and class action waiver provisions in Section 16.
1. Acceptance of Terms
By accessing or using Companion AI, you agree to:
- Be bound by these Terms
- Comply with our Privacy Policy
- Be at least 18 years of age
- Use the App in accordance with all applicable laws
If you do not agree to these Terms, you may not use the App.
2. Description of Service
Companion AI provides an AI-powered conversational companion service with the following features:
- AI Conversations: Chat with AI companions featuring different personalities
- Mood Tracking: Log and analyze your emotional well-being (optional)
- Memory System: Conversations are remembered for continuity
- Free Tier: 50 messages per day
- Pro Subscription: Unlimited messages, advanced mood analytics, and premium features
Disclaimer: Companion AI is an entertainment and wellness tool. It is NOT a substitute for professional mental health care, therapy, medical advice, or human relationships. If you are experiencing a crisis, please contact emergency services or a mental health professional immediately.
3. Eligibility
To use Companion AI, you must:
- Be at least 18 years old
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the service under applicable laws
- Provide accurate registration information
We reserve the right to refuse service or terminate accounts that violate these eligibility requirements.
4. Account Registration
4.1 Account Creation
- You must create an account to use the App
- You are responsible for maintaining account security
- You must provide accurate and current information
- One account per person; no account sharing
4.2 Account Security
- Keep your password confidential
- Notify us immediately of unauthorized access
- You are responsible for all activity under your account
4.3 Account Termination
You may delete your account at any time in Settings. Upon deletion:
- Your data will be deleted within 30 days
- Active subscriptions will not be refunded (see Section 7)
- You may lose access to conversation history
5. Acceptable Use Policy
5.1 Permitted Uses
You may use Companion AI for:
- Personal companionship and emotional support
- Casual conversation and entertainment
- Mood tracking and self-reflection
- Personal development and goal setting
5.2 Prohibited Uses
You may NOT:
- Use the App if you are under 18 years old
- Attempt to manipulate, exploit, or harm the AI
- Use the App for illegal activities or to promote violence
- Share content that is hateful, abusive, or discriminatory
- Attempt to reverse engineer, hack, or compromise the App
- Create multiple accounts to bypass message limits
- Resell, redistribute, or commercialize the service
- Use automated tools (bots, scripts) to interact with the App
- Impersonate others or provide false information
- Violate others' privacy or intellectual property rights
6. Intellectual Property
6.1 Our Rights
Companion AI and its content are protected by copyright, trademark, and other intellectual property laws. We (or our licensors) own all rights to:
- The App's design, code, and features
- AI models and conversation algorithms
- Companion AI branding, logos, and trademarks
- All content provided by the App
6.2 Your Rights
You retain ownership of content you create, including:
- Your messages and conversation inputs
- Mood entries and personal notes
6.3 License to Us
By using the App, you grant us a limited, non-exclusive license to:
- Store and process your conversations to provide the service
- Use anonymized, aggregated data to improve AI models
- Display your content back to you within the App
Important: We will never sell your personal conversations or use them for advertising. See our Privacy Policy for details.
7. Subscription and Payments
7.1 Free Tier
- 50 messages per day, resets at midnight UTC
- Basic mood tracking
- Weekly mood insights
7.2 Pro Subscription
Pricing:
- Monthly: £11.99/month (or local equivalent)
- Annual: £79.99/year (or local equivalent)
Pro Features:
- Unlimited messages
- Romantic Partner personality mode
- Advanced mood analytics and AI insights
- Monthly and time-of-day mood analysis
- Priority support
7.3 Billing
- Subscriptions are billed through Apple's In-App Purchase system
- Payment is charged at confirmation of purchase
- Subscriptions auto-renew unless canceled 24 hours before renewal
- Manage subscriptions in your iOS Settings > Apple ID > Subscriptions
8. AI and Conversation Limitations
Understanding AI Limitations: Companion AI uses advanced AI technology, but it has important limitations you should understand.
8.1 What AI Can Do
- Engage in natural, contextual conversations
- Remember past conversations and build continuity
- Provide emotional support and companionship
- Offer general advice and perspectives
8.2 What AI Cannot Do
- Replace human relationships: AI companionship is not equivalent to human connection
- Provide professional services: Not therapy, medical advice, legal counsel, or financial guidance
- Be 100% accurate: AI can make mistakes, provide incorrect information, or misunderstand context
- Have true emotions: AI responses simulate emotional understanding but lack genuine feelings
- Make decisions for you: AI can provide perspectives but you are responsible for your choices
8.3 No Professional Advice
Companion AI does NOT provide:
- Mental health therapy or crisis intervention
- Medical diagnosis or treatment recommendations
- Legal advice or representation
- Financial advice or investment recommendations

9. Data and Privacy
Your use of Companion AI is also governed by our Privacy Policy, which explains:

- Conversations are encrypted in transit and at rest
- We never sell your personal data or conversations
- You can export or delete your data anytime
- AI processing is done through secure third-party APIs (Together.AI)
10. Disclaimers and Limitations of Liability
10.1 Service "As Is"
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- That the service will be uninterrupted, secure, or error-free
- That AI responses will be accurate, complete, or appropriate
- That defects will be corrected
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE PAST 12 MONTHS (OR £100, WHICHEVER IS LESS)
- WE ARE NOT LIABLE FOR ANY HARM RESULTING FROM AI CONVERSATIONS OR ADVICE
- WE ARE NOT LIABLE FOR DATA LOSS DUE TO THIRD-PARTY SERVICE FAILURES
11. Modifications to Service and Terms
11.1 Service Changes
We reserve the right to:
- Modify, suspend, or discontinue any feature
- Change pricing (with notice for active subscribers)
- Update AI models and capabilities
11.2 Terms Changes
We may update these Terms at any time. Changes will be effective:
- Immediately for new users
- 30 days after notification for existing users
Continued use after changes constitutes acceptance.
